The Custom Jeweler Quote - Terms & Conditions


CAD Design Deposit

A non-refundable deposit of $250 is required to initiate CAD (Computer-Aided Design) work. This deposit covers the cost of design development and is applied toward the total project balance upon acceptance. The Buyer will have the opportunity to request two (2) round of revisions to the CAD rendering at no additional charge. If a third round of revisions is required, we reserve the right to charge an additional fee of $100. Upon review of the completed CAD rendering, the Buyer is under no obligation to proceed further. If the Buyer elects not to move forward with the project after the CAD stage, no additional payments will be required and no further financial obligation to The Custom Jeweler will exist beyond the $250 CAD deposit. The CAD files, renderings, and all associated design work shall remain the sole intellectual property of The Custom Jeweler.


Payment Terms

  1. A deposit of 50% is required upon acceptance of the Project Quote to commence work.
  2. Final balance is due upon completion, prior to shipment.
  3. Payment methods accepted: Quickpay,Zelle, Bank ACH.
  4. Any payment fees must be borne by the buyer (i.e. amounts must arrive to The Custom Jeweler net of fees).


Changes, Cancellations & Modifications

  1. Any design changes, material substitutions, or scope modifications requested by the Buyer after acceptance of the CAD design files may trigger cost adjustments, schedule delays, or additional charges.
  2. Title to the custom-made jewelry described herein shall remain the sole property of The Custom Jeweler until full payment has been received. If the Buyer fails to remit the final 50% balance within 30 days of project completion, The Custom Jeweler reserves the right to retain full ownership of the piece, and the Buyer shall forfeit any deposits or prior payments made. The Custom Jeweler may, at its sole discretion, resell or otherwise dispose of the piece without further obligation to the Buyer.

Product Information

  1. While we have taken reasonable steps to accurately depict Product(s) through the photographs and other images sent to you, some items may appear slightly larger or smaller than actual size due to screen defaults and photography techniques.
  2. Other items may be represented at a larger than actual size to clearly show details, or smaller than actual size to show the entire item. Additionally, the detailing (such as color, pattern, texture, etc.) you see on-screen may depend on your monitor and, as such, may not exactly reflect the actual detailing of a Product when you receive it.


Delivery & Lead Times

  1. Shipping / transit time: Allow 2 business days depending on location and carrier.
  2. The Custom Jeweler shall not be liable for delays caused by customs, import duties, force majeure, carrier issues, or other events beyond The Custom Jeweler's control.


Quality Assurance, Inspection & Acceptance

  1. Buyer shall have 2 daysafter receipt to inspect and report any defects or non-conformities in writing.
  2. If it arrives damaged or defective (not due to your use), notify us promptly. We’ll arrange a free return. We’ll repair, replace, or refund the item — including shipping costs — provided it has not been worn or damaged by you. If replacement is preferred, we’ll send it at no extra cost where possible.
  3. After that period, the goods shall be deemed accepted.
  4. Minor deviations (within tolerances) do not constitute grounds for return or rework unless specifically agreed by The Custom Jeweler.


Warranty & Limitations

  1. All jewelry purchased from The Custom Jeweler is covered by our one-year limited warranty against manufacturing defects. This warranty is valid for the first year from the date of purchase, provided the jewelry has been subjected only to normal wear and usage and all components are returned to The Custom Jeweler for review and inspection.
  2. Warranty repairs are subject to inspection and approval solely by The Custom Jeweler. This warranty specifically excludes repairs needed due to excessive wear and tear, physical or accidental damage, loss, or theft.
  3. Our one-year limited warranty does not entitle customers to any refunds or reimbursements.
  4. Please be aware that repairs, modifications, or warranty services performed by any jeweler other than The Custom Jeweler after purchase will void this warranty, as we cannot assure the quality of workmanship provided by others.
  5. If your jewelry becomes damaged or requires refurbishment due to unusual or excessive wear and you wish to repair it, please call or email for an estimate of the cost. Our skilled jewelers can perform many types of repairs.
  6. Warranty coverage applies solely to the original purchaser and is non-transferable.
  7. The Custom Jeweler shall not be responsible or liable for incidental or consequential damages arising from any breach of warranty—written or implied—including warranties of merchantability or fitness for any specific purpose. This warranty provides specific legal rights; additional rights may vary by state. Some jurisdictions restrict the exclusion or limitation of incidental or consequential damages; thus, the above exclusions or limitations may not apply to all customers.
  8. The Custom Jeweler will not be responsible for the replacement of any lost component including any diamonds or gemstones.


Intellectual Property & Ownership

  1. Designs, CAD files, molds, etc. developed remain the property of The Custom Jeweler.
  2. Buyer is granted rights to the finished goods only.
  3. Use of trademarks, logos, or copyrighted design elements by Buyer must be authorized.


Governing Law, Dispute Resolution & Jurisdiction

  1. This agreement (and any final invoice / contract) shall be governed by the laws of New York state.
  2. Venue for disputes shall be New York.
  3. Parties shall attempt in good faith to resolve disputes by mediation / arbitration before litigation.


Liability & Indemnification

  1. The Custom Jeweler’s liability is limited to the amount actually paid by Buyer under the final invoice.
  2. The Custom Jeweler is not liable for consequential, incidental, or punitive damages.
  3. Buyer shall indemnify and hold The Custom Jeweler harmless from claims arising from Buyer’s use, misuse, or resale of the goods.


Force Majeure

  1. The Custom Jeweler shall not be liable for failure or delay in performing obligations due to causes beyond its control (e.g. natural disasters, strikes, supply chain disruptions, government actions).
  2. In such an event, The Custom Jeweler may extend delivery or cancel the order with notice, without penalty.


Miscellaneous

  1. This Project Quote plus any signed acknowledgement or purchase order accepted by The Custom Jeweler form the complete and exclusive understanding of the parties.
  2. No verbal modifications are binding unless confirmed in writing.
  3. If any provision is held invalid, the remainder continues in full force and effect.
  4. Project Quotes are price quotes and not tax invoices.
